Who are we and what is this Policy for?

The Moment Leader platform (“Moment Leader” or “Platform”) is owned and operated by Moment Leader Holdings Pty Ltd (ACN 664 679 449) of Level 5, 32-36 York Street, Sydney NSW 2000 (“We” or “Us”).

Our mission at Moment Leader is to improve the experience of work and life through everyday moments. We aim to create a supportive space for you to learn, reflect and plan for moments that are important to you.

Your privacy is important to us and this Privacy Policy (“Policy”) sets out how we collect, hold, use and disclose personal information.

We may change this Policy from time to time by publishing updates on Moment Leader. We encourage you to check periodically to make sure you are up to date with our current Policy.

What personal information do we collect?

Personal information is information or opinion (whether true or not) about an identified individual or an individual who is reasonably identifiable.

The personal information we collect about you depends on the nature of your dealings with us or what you choose to share with us as you use Moment Leader, and through methods such as voluntary surveys. On that note, it is important to understand that the use and effectiveness of Moment Leader largely depends on the information you choose to submit when using our tools, and that information comprises a significant portion of the personal information we collect about you.

Your content Content you submit to Moment Leader when you engage with our prompts and tools, such as questions and answers to prompts, posts, comments, journal entries, your goals, completing and updating behaviour, mood, or goal trackers.

Aggregated data

We may also collect aggregated data, such as statistical or demographic data. Aggregated data could be derived from your personal information but it will not directly or indirectly reveal your identity.

Sensitive information

We may collect sensitive information with your consent. Usually this will occur when you include sensitive information in the content you submit to Moment Leader. You choose whether you provide us with sensitive information and what sensitive information you provide. This may include information about your health, any disabilities, your racial or ethnic origin, your political opinions, religious beliefs or affiliations, but the type and extent of sensitive information provided is up to you.

You can choose not to provide information to us or deal with us anonymously, but in general some information about you is required in order for to you to access Moment Leader (such as to create a user account).

How do we collect your personal information?

We generally collect your information directly from you when you interact with us through the Moment Leader platform or otherwise, participate in surveys or questionnaires, create content on the Moment Leader platform, or subscribe to our mailing list.

However, in some circumstances we may collect your information from third parties such as:

  • your employer where your access to Moment Leader is provided through your employer.
  • our affiliated entities and partners.
  • publicly available sources.
  • any information you provide to third parties that are associated or whose products or services are integrated with Moment Leader.

How do we use your personal information?

We use your information for the following purposes:

  • To provide and optimise our services and products to you and your organisation, including to provide a customised user experience on Moment Leader based on your information (particularly your own inputs to our tools).
  • To identify and develop new services and products that you, your organisation or our clients might be interested in.
  • To conduct, monitor and analyse our business and internal operations.
  • To communicate with you, including to send you updates, notifications, newsletters and new service or product offerings, or respond to your queries or complaints.
  • To market Moment Leader and our services, and measure, gauge and improve the effectiveness of our marketing.
  • For security purposes, such as detecting security incidents or illegal activities, fixing problems with our services, and complying with our legal obligations.
  • To comply with our legal obligations.

To whom do we disclose your personal information?

We may share your information with third parties in limited circumstances. These include:

  • Our related companies and independent contractors who need the information to help us provide our services or process information on our behalf.
  • Suppliers that help us provide our services to you, such as cloud storage services, hosting services, email delivery services that help us stay in touch with you, and user database providers.
  • Suppliers that help us with our marketing and to understand and enhance our services. These include vendors in the areas of user experience (such as Hotjar, Dovetail), and analytics (such as Google Analytics, Smartlook, Amplitude),
  • Government or regulatory authorities or other organisations as required by law.
  • Professional service providers and advisors.

All disclosures to third parties are on a need-to-know basis.

Some of our suppliers we disclose personal information to may be located or may receive access, process, host or store your information outside Australia. These generally include the United States of America, the United Kingdom and the European Union.

How do we store and keep your information secure?

We take reasonable steps to keep your personal information secure. We use a variety of physical and electronic security measures to keep your personal information secure from misuse, interference, loss or unauthorised access, use or disclosure. These include training our staff in how to keep your information secure, and using trusted service providers (including cloud storage providers) to store your information.

However, we cannot guarantee the safety of your personal information. No online service is absolutely secure, and information provided by you to the Moment Leader platform is provided at your own risk.

The Platform and our communications with you may contain links to websites operated by third parties. Unless we tell you otherwise, we are not responsible for the privacy practices or content of those linked websites. The privacy policies that apply to those website may be different from this Policy, so we encourage you to read them carefully.

Online Activity

The Moment Leader platform uses cookies. A cookie is a small file stored on your web browser if you allow it. We use session cookies (to maintain contact with you throughout a browsing session) and persistent cookies (for statistical purposes and to improve Moment Leader).

We do not use cookies to identify you, just to improve your experience. Some cookies are necessary for essential Platform functions. Others may be used for personalised advertising. You have control over the cookies implemented and your consent is required before any cookies are activated. However, if you remove or block cookies please be aware that your experience may be affected.

We use analytics services to help us better understand user traffic so we can improve our services. Although this data is mostly anonymous, aggregated or deidentified, it is possible that under certain circumstances we may connect it to you.

We and our partners also collect information such as the pages you access on our website, the documents you download, the amount of time you spend on a page, which links you use to access our site and the type of device and browser you use. This information is used to improve the services we offer you, and for statistical, website development and functionality purposes.

We may send you direct marketing communications and information about our services, opportunities or events that we think may be of interest to you if you have requested or consented to receive those communications. You may opt-out of receiving marketing communications from us at any time by contacting us or following the unsubscribe instructions in the communication.

Retention of personal information

We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us (for example, for the time you have an active user account with Moment Leader). Sometimes we may need to retain your personal information for a longer period to comply with the law. We may also retain your information in a deidentified manner for the purposes of ongoing analytics.

Your rights

You have rights under the Privacy Act and Spam Act to:

  • Request access to personal information we hold about you.
  • Ask us to update or correct any information that is out of date or incomplete or inaccurate.
  • Opt-out of receiving direct marketing communications from us.

If you are located in a country to which the European General Data Protection Regulation (GDPR) applies, you may have additional rights in relation to your personal information under certain conditions, such as:

  • The right to object to our use and processing of your personal information.
  • The right to request that we restrict our use and processing of your personal information.
  • The right to request that we erase your personal information.
  • The right to request that we transfer the personal information we hold about you to another organisation or directly to you.

You can make a request do any of these things by contacting our Privacy Officer or Head of Product. We try to respond to your request within one month, but we will keep you updated on the status of your request.

When you make a request, we may need to verify your identify. Sometimes there may be a valid reason for us to deny your request, and if we do this we will tell you why.

There is no cost to you to make a request, but we may charge a reasonable cost to provide you with access to your information.

Making a complaint

If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your personal information, you can contact our Privacy Officer.

Your complaint should include your name, email address and phone number and clearly describe your complaint. Any complaint will be investigated by us and the outcome will be communicated to you as soon as we can.

If you are not satisfied with the outcome of any internal investigation we conduct, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at enquires@oaic.gov.au or on 1300 363 992.
